MiMiSpot's role in the property marketplace

MiMiSpot operates an online marketplace that lets property owners, landlords, property managers and agents ("listers") publish listings, and lets prospective buyers, renters and tenants ("seekers") discover properties, express interest, request viewings and submit rental applications. MiMiSpot is not a party to any sale, lease or tenancy concluded between a lister and a seeker.

MiMiSpot does not hold itself out as a licensed real-estate broker, licensed agent, conveyancer, surveyor, valuer or law firm. Any brokerage, legal, survey or valuation service you need must be obtained from an appropriately qualified professional of your choosing.

Who these terms apply to

These terms apply whenever you publish, manage or respond to a sale, long-term rental or lease listing on MiMiSpot, or when you express interest in, request a viewing of, or apply for such a property. They supplement the Terms of Use, the Host, Owner & Agent Terms and the Privacy Policy, which continue to apply.

Listing responsibilities

• Describe the property, its location, size, condition, price or rent, included fixtures, availability and any material restrictions truthfully and keep the listing current.
• Use only photographs and floor plans of the actual property that you have the right to use.
• State the type of interest actually offered (for example freehold sale, leasehold, long-term rental) and do not describe an interest you cannot grant.
• Disclose known material defects, disputes, encumbrances or planning restrictions that a reasonable seeker would want to know before proceeding.
• Update the listing status promptly when the property is under offer, let, sold or withdrawn.

Ownership and authorisation representations

By publishing a listing you represent that you are the owner of the property, or that you hold written authority from the owner, a court, an estate or another person with the legal right to authorise you, to advertise and negotiate the sale, lease or rental of that property. MiMiSpot may ask you to demonstrate that authority at any time and may pause or remove a listing until it is demonstrated.

A listing is not proof of title

MiMiSpot does not guarantee legal ownership, title, boundaries or the absence of competing claims merely because a listing exists. MiMiSpot verification, where shown, indicates that specified information or documentation has been reviewed; it does not constitute a government determination of ownership, legal title, property boundaries or absence of competing claims.

Property leads and attribution

When a seeker expresses interest, requests a viewing or submits an application through MiMiSpot, a property lead record is created and linked to the listing, the lister and the seeker. The lead records the channel through which the introduction was made, the date and time, and status changes reported by either side. Lead records exist so that both sides have a shared, dated history of the introduction and so that MiMiSpot can operate its safety, support and anti-fraud processes.

Listers must not ask seekers to move a MiMiSpot-originated inquiry off the platform in order to avoid MiMiSpot's records, safety measures or any programme terms that may apply to the listing.

Inquiry handling by listers

• Respond to inquiries, viewing requests and applications within a reasonable time and through MiMiSpot messaging where available.
• Treat every seeker fairly and do not discriminate on grounds prohibited by applicable law.
• Do not request payment of any deposit, fee or reservation amount before the seeker has had the opportunity to inspect the property and verify your authority, unless clearly agreed in writing.
• Keep seekers' personal information confidential and use it only to progress the inquiry.

Viewing requests

A viewing request is a request only. A viewing is arranged when the lister confirms a date and time. Both parties should attend as agreed or cancel in good time through the platform. Seekers attend viewings at their own risk and should take ordinary safety precautions, including telling someone where they are going and, where practical, viewing during daylight hours.

Long-term rental applications

A rental application submitted through MiMiSpot is an expression of interest to rent and is not a tenancy. A tenancy arises only when the lister and applicant sign the tenancy or lease agreement and satisfy any conditions stated in it. Applicants must provide accurate information and may be asked for identity, income or reference details; listers must use that information only to assess the application and must retain it no longer than necessary.

Property-sale interest

Expressing interest in a property for sale does not create an offer, an option, a reservation or a binding agreement. Any offer, exchange of contracts, deposit, completion or transfer of title takes place outside the platform, under documents prepared by the parties' own advisers and in accordance with applicable law. MiMiSpot does not hold deposits or purchase money for property transactions.

Transaction-status reporting

Listers and seekers may report the progress of an inquiry (for example viewing completed, application submitted, offer accepted, tenancy signed, sale completed, or withdrawn). Reports must be truthful. A reported outcome is recorded against the lead and may be reviewed by MiMiSpot; MiMiSpot may ask either party to confirm a reported outcome and may correct records that are shown to be inaccurate.

Platform fees for sale and lease introductions

No success, commission or introduction fee is charged for sales or long-term leases introduced through MiMiSpot at this time. Any future fee of that kind would be set out in a separate schedule, would apply only to introductions made after it takes effect, and would require your express acceptance before it applies to you.

Due diligence before a purchase or long-term lease

• Identity of the seller or lessor, and their authority to transact.
• Ownership or the interest actually being sold or leased.
• Survey and boundary information.
• Encumbrances, charges or competing claims, where applicable.
• Planning and permitted-use restrictions.
• Taxes, rates and outstanding charges.
• Lease terms, renewal and termination rights.
• Property condition and utility status.
• Government and local authority requirements.

Independent advice

MiMiSpot's platform verification does not substitute for independent professional due diligence, legal advice, survey or valuation. Never transfer funds for a property transaction on the strength of a listing alone.

Foreign participation

Some sale and long-term lease listings show an informational foreign-participation indicator. It is not a legal opinion about your eligibility to acquire an interest in the property. If you are not a citizen or resident of the country where the property is located, obtain independent legal advice before committing to any transaction.

Privacy and confidentiality

Personal information exchanged through the property marketplace is handled under the Privacy Policy. Exact addresses of private residences are shared only when a viewing or another authorised step justifies it. Each party must keep the other party's personal and financial information confidential and must not publish, sell or use it for unrelated marketing.

Prohibited conduct

• Advertising a property you do not own or are not authorised to offer.
• Advance-fee, bait-and-switch or duplicate-deposit schemes.
• Publishing misleading prices, photographs or availability.
• Harassing, threatening or discriminating against another user.
• Circumventing MiMiSpot records, safety measures or messaging to conceal an introduction.
• Using the marketplace to collect personal information for purposes unrelated to a genuine property transaction.

Suspension and removal

MiMiSpot may pause, edit the visibility of, or remove a listing, and may suspend or close an account, where these terms, the Terms of Use or applicable law appear to have been breached, where a safety or fraud concern is raised, or where authority to list cannot be demonstrated. Where practical MiMiSpot will tell you what happened and how to respond. Records needed for safety, legal or audit purposes may be retained after removal.

Platform limitations

MiMiSpot provides the marketplace "as available". MiMiSpot does not inspect properties, does not verify every statement in a listing, does not guarantee that a property is available, priced correctly, lawful to let or sell, or suitable for your purpose, and is not responsible for the conduct of listers or seekers. To the extent permitted by law, MiMiSpot's liability in connection with the property marketplace is limited as set out in the Terms of Use.

Disputes and how to contact us

If you have a complaint about a listing, a lister, a seeker or a lead record, first raise it through MiMiSpot support in the app or website so that it can be recorded against the relevant listing. Disputes between a lister and a seeker about a sale, lease or tenancy are between those parties; MiMiSpot may assist with records it holds but does not adjudicate property transactions. Applicable law

These terms are governed by the law stated in the Terms of Use. Property transactions themselves are governed by the law of the place where the property is located, and nothing in these terms limits rights you have under that law that cannot be excluded by agreement.
